Terms of Service

1. Acceptance of Terms

By accessing or using WonAnother ("the Platform," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Platform. These Terms apply to all users, including disciples, mentors, ministry leaders, and organizational administrators.

2. Description of Service

WonAnother is a discipleship intelligence platform that provides spiritual growth assessments, personalized learning paths, habit tracking, journaling tools, mentorship management, and organizational analytics. The Platform is intended for use by individual believers, mentors, and church or ministry organizations ("Organizations"). Features may vary based on subscription tier.

3. User Accounts and Registration

To access the Platform, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use. We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently.

4. Subscription, Billing, and Payment

Access to certain features of the Platform requires a paid subscription. Subscriptions are billed on a monthly or annual basis, as selected at the time of purchase. All fees are non-refundable except as expressly stated herein or required by applicable law. We use Stripe to process all payments. By providing payment information, you authorize us to charge the applicable fees. We reserve the right to modify pricing with thirty (30) days' prior notice. Failure to pay may result in suspension or termination of access.

5. Free Trial

We may offer a free trial period for new users. At the end of the trial period, your account will automatically convert to the free "The Disciple" tier unless you subscribe to "The Follower" tier or above before the trial expires. You can upgrade or downgrade your level of service at any time. We reserve the right to modify or discontinue free trial offerings at any time.

6. User Content

The Platform allows you to submit, upload, and share content including journal entries, reflections, discussion posts, and other materials ("User Content"). You retain ownership of your User Content. By submitting User Content, you grant WonAnother a limited, non-exclusive, royalty-free license to use, store, and display your content solely as necessary to provide the Platform's services. You are solely responsible for the accuracy, legality, and appropriateness of your User Content. We do not endorse User Content and disclaim all liability arising from it.

7. Privacy and Data

Your use of the Platform is subject to our Privacy Policy, which is incorporated herein by reference. We collect and process personal data in accordance with applicable data protection laws, including but not limited to the California Consumer Privacy Act (CCPA). Spiritual assessment responses, journal entries, and progress data are treated as sensitive personal information and are not sold or shared with third parties except as described in our Privacy Policy.

8. Organizational Accounts

Organizations subscribing to enterprise or ministry plans accept these Terms on behalf of all users within their account. Organizational administrators are responsible for ensuring that all users within their Organization comply with these Terms. WonAnother is not responsible for actions taken by administrators or members within an Organization's account.

9. Prohibited Uses

You agree not to: (a) use the Platform for any unlawful purpose or in violation of any applicable laws; (b) reproduce, distribute, or create derivative works from Platform content without express written permission; (c) attempt to gain unauthorized access to any part of the Platform or its related systems; (d) use automated tools, bots, or scrapers to access the Platform; (e) transmit harmful, offensive, or disruptive content; (f) impersonate any person or entity; or (g) use the Platform in a manner that could harm minors.

10. Intellectual Property

All content, trademarks, logos, and intellectual property on the Platform, excluding User Content, are owned by or licensed to WonAnother and are protected by applicable intellectual property laws. You may not use, copy, or reproduce any Platform content without our prior written consent.

11. Third-Party Services and Integrations

The Platform may integrate with third-party services such as Stripe (payments), Google (authentication and storage), Resend (email), and others. Your use of these third-party services is subject to their respective terms and privacy policies. We are not responsible for the availability, accuracy, or content of third-party services.

12. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, WONANOTHER DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WONANOTHER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE PLATFORM. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATING TO THESE TERMS OR THE PLATFORM SHALL NOT EXCEED THE FEES PAID BY YOU IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

14. Indemnification

You agree to indemnify, defend, and hold harmless WonAnother and its officers, directors, employees, and agents from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your use of the Platform, your User Content, or your violation of these Terms.

15. Termination

We may suspend or terminate your access to the Platform at any time, with or without cause, and with or without notice. Upon termination, your right to use the Platform will immediately cease. You may export your data before termination; we will retain your data for a limited period post-termination in accordance with our Privacy Policy.

16. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising from these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association (AAA), conducted in English in Texas.

17. Changes to These Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by updating the "Last Updated" date and, where appropriate, by notifying you via email or in-app notification. Your continued use of the Platform following any changes constitutes your acceptance of the revised Terms.
